Because of the time and resources required, not every case is worth pursuing. The following are examples of things we look for to determine a viable case:
- Did you see a doctor soon after the accident to establish a record of injury?
- Have you consistently kept your doctor’s visits, and not ignored your pain or injuries?
- Is there likely to be a liable party? Liability rules may differ depending on the type of case and where the accident took place.
- Is there a source of recovery? Money is the only compensation available in injury cases under our system of law. So we look for a liable party that has access to funds for an award.
- If your case involves possible medical malpractice or nursing home negligence, we will have to prove that the healthcare team failed to provide safe or adequate care, and that this failure was the direct cause of your injury.
